Terms of service

The agreement that will govern creators, supporters and TackNote. This is the working outline.

01Who these terms are between

  • TackNote operates tacknote.xyz and the gift-forwarding service described on it.
  • These terms apply to creators who publish a wishlist and to supporters who send gifts.

To be drafted

  • Confirm the registered legal entity name, company number and registered address.
  • Decide the governing law and the courts with jurisdiction over disputes.

02Accounts and eligibility

  • Creating a page requires an email address and a unique handle. No identity documents are required to receive gifts.
  • Identity verification is required only to withdraw gifted funds as money, because payment processors are legally obliged to collect it.

To be drafted

  • Set the minimum age and describe how it is checked.
  • Set out grounds for suspending or closing an account, and the appeal route.
  • Describe what happens to a pending gift when an account is suspended.

03How gifting works

  • Supporters buy an item or contribute towards one. The gift is delivered to a TackNote fulfilment centre and forwarded to the creator.
  • A gift is a gift. Supporters receive no goods, equity or entitlement in return.

To be drafted

  • State when title in an item passes to the creator.
  • Define the position on customs duties and import taxes for cross-border forwarding.
  • Describe what happens if an item is out of stock, delayed, damaged or never arrives.

04Fees

  • TackNote charges a flat 0.5% service fee. There is no subscription and no listing fee.
  • Payment processing fees charged by third parties are shown separately before checkout.

  • State exactly what the 0.5% is calculated on, and who pays it.
  • Set the notice period required before changing fees.
  • Confirm the treatment of sales tax and VAT by jurisdiction.

05Acceptable use

  • Wishlists must not include regulated, illegal or dangerous goods.
  • Impersonating another creator, or soliciting gifts on someone else's behalf without permission, is not allowed.

  • Publish the full prohibited-items list and link it here.
  • Describe the reporting route and the takedown process, with timescales.

06Crowdfunded items

  • Decide what happens to contributions when an item never reaches its goal: refund, credit, or redirect.
  • Set whether a creator can cancel a crowdfund partway, and on what terms.
  • Define the position when an item's price changes mid-campaign.

07Liability and warranties

  • Draft the warranty disclaimer and the limitation of liability, with caps.
  • Confirm which statutory consumer rights cannot be excluded in each market served.

08Changes to these terms

  • Set the notice period and the method of notifying users of material changes.
  • Decide whether continued use constitutes acceptance.
